Article LO6371-3 of the French General Code of Local Authorities

The collectivity of Saint-Martin is substituted for the State, the region or department of Guadeloupe or the commune of Saint-Martin in their rights and obligations resulting from the contracts and markets that these have concluded for the development, maintenance and conservation of the property handed over to the collectivity of Saint-Martin pursuant to articles LO 6371-1 and LO 6371-2 as well as for the operation of services.

The State, the region or the department of Guadeloupe record these substitutions and notify them to their co-contractors.

La collectivité de Saint-Martin est substituée à l’Etat, la région ou le département de la Guadeloupe ou la commune de Saint-Martin dans leurs droits et obligations résultant des contrats et marchés que ceux-ci ont conclus pour l’aménagement, l’entretien et la conservation des biens remis à la collectivité de Saint-Martin en application des articles LO 6371-1 et LO 6371-2 ainsi que pour le fonctionnement des services.

L’Etat, la région ou le département de la Guadeloupe constatent ces substitutions et les notifient à leurs cocontractants.
