Article LO6442-1 of the French General Code of Local Authorities

I. – The Territorial Council may submit to a referendum any draft deliberation tending to regulate a matter within its competence, with the exception, on the one hand, of the opinions it is called upon to give on draft and proposed legislation and on draft ordinances, and, on the other hand, of the proposals it may adopt within the framework of articles LO 6461-12, LO 6461-14 and LO 6461-15.

II. – On a proposal from the Executive Council, the Territorial Council may submit to a referendum any draft regulatory act falling within the remit of the President of the Territorial Council or the Executive Council.

III. – The articles LO 1112-3 to LO 1112-14 are applicable to the collectivity of Saint-Pierre-et-Miquelon.

IV. – The provisions of the Electoral Code referred to in articles LO 1112-9 to LO 1112-13 of the present code are applicable under the conditions laid down by Chapter I of Title IV of Book VI of the Electoral Code.

Article LO6442-1

I. – Le conseil territorial peut soumettre à référendum tout projet de délibération tendant à régler une affaire de sa compétence, à l’exception, d’une part, des avis qu’il est appelé à rendre sur les projets et propositions de loi et sur les projets d’ordonnance, d’autre part, des propositions qu’il peut adopter dans le cadre des articles LO 6461-12, LO 6461-14 et LO 6461-15.

II. – Sur proposition du conseil exécutif, le conseil territorial peut soumettre au référendum tout projet d’acte réglementaire relevant des attributions du président du conseil territorial ou du conseil exécutif.

III. – Les articles LO 1112-3 à LO 1112-14 sont applicables à la collectivité de Saint-Pierre-et-Miquelon.

IV. – Les dispositions du code électoral mentionnées aux articles LO 1112-9 à LO 1112-13 du présent code sont applicables dans les conditions fixées par le chapitre Ier du titre IV du livre VI du code électoral.
