Article LO6451-1 of the French General Code of Local Authorities

The acts taken by the authorities of the collectivity are enforceable by operation of law as soon as they have been published in the Official Journal of Saint-Pierre-et-Miquelon, posted or notified to the interested parties and transmitted to the representative of the State.

The publication or posting of these acts is also organised, on a complementary but non-exclusive basis, in digital format.

The president of the territorial council certifies, under his responsibility, the enforceability of these acts.

The transmission of these acts may be carried out by any means, including by electronic means in accordance with procedures laid down by decree in the Council of State.

Proof of receipt of the acts by the representative of the State may be provided by any means. The acknowledgement of receipt, which is issued immediately, may be used for this purpose but is not a condition of the enforceability of the acts.

Les actes pris par les autorités de la collectivité sont exécutoires de plein droit dès qu’il a été procédé à leur publication au Journal officiel de Saint-Pierre-et-Miquelon, à leur affichage ou à leur notification aux intéressés ainsi qu’à leur transmission au représentant de l’Etat.

La publication ou l’affichage de ces actes est également organisé, à titre complémentaire mais non exclusif, sur support numérique.

Le président du conseil territorial certifie, sous sa responsabilité, le caractère exécutoire de ces actes.

La transmission de ces actes peut s’effectuer par tout moyen, y compris par voie électronique selon des modalités fixées par décret en Conseil d’Etat.

La preuve de la réception des actes par le représentant de l’Etat peut être apportée par tout moyen. L’accusé de réception, qui est immédiatement délivré, peut être utilisé à cet effet mais n’est pas une condition du caractère exécutoire des actes.
