Article LO6452-5 of the French General Code of Local Authorities

When an appeal for misuse of power or an appeal for assessment of legality directed against the acts mentioned in 1° to 3° of article LO 6451-2 and that this appeal is based on a serious plea alleging the incorrect application of the division of powers between the State, the local authority and the communes, or that this plea is raised ex officio, it immediately forwards the case to the Conseil d’Etat for an opinion, in a ruling that is not subject to appeal. The Conseil d’Etat examines the question raised within a period of three months and any decision on the merits is deferred until its opinion or, failing that, until the expiry of this period. The administrative court shall rule within two months of the publication of the opinion in the Journal officiel de la République française or of the expiry of the time limit given to the Conseil d’Etat.

Lorsque le tribunal administratif est saisi d’un recours pour excès de pouvoir ou d’un recours en appréciation de légalité dirigé contre les actes mentionnés aux 1° à 3° de l’article LO 6451-2 et que ce recours est fondé sur un moyen sérieux invoquant l’inexacte application de la répartition des compétences entre l’Etat, la collectivité et les communes ou que ce moyen est soulevé d’office, il transmet le dossier sans délai pour avis au Conseil d’Etat, par un jugement qui n’est susceptible d’aucun recours. Le Conseil d’Etat examine la question soulevée dans un délai de trois mois et il est sursis à toute décision sur le fond jusqu’à son avis ou, à défaut, jusqu’à l’expiration de ce délai. Le tribunal administratif statue dans un délai de deux mois à compter de la publication de l’avis au Journal officiel de la République française ou de l’expiration du délai imparti au Conseil d’Etat.
