Article LO6454-1 of the French General Code of Local Authorities

Agreements between the State and the territorial collectivity of Saint-Pierre-et-Miquelon set out the terms and conditions under which State agents and services are made available to the collectivity and to the President of the Territorial Council, on a permanent basis and as required, in particular for the preparation and execution of the deliberations of the Territorial Council.

Under the conditions set out in the aforementioned agreements, the President of the Territorial Council sends directly to the heads of the services referred to in the first paragraph any instructions necessary for the execution of the tasks that he entrusts to the said services. He supervises the execution of these tasks.

He may, under his supervision and responsibility, delegate his signature to the heads of the said services for the execution of the tasks he entrusts to them in application of the second paragraph.

Under the conditions laid down by the agreements referred to in the first paragraph, the President of the Territorial Council communicates each year to the representative of the State his assessment of the operation of the State services placed at his disposal.

Des conventions entre l’Etat et la collectivité territoriale de Saint-Pierre-et-Miquelon fixent les modalités selon lesquelles les agents et les services de l’Etat sont mis à la disposition de la collectivité et du président du conseil territorial, de façon permanente et en tant que de besoin, notamment pour la préparation et l’exécution des délibérations du conseil territorial.

Dans les conditions prévues par les conventions susmentionnées, le président du conseil territorial adresse directement aux chefs des services visés au premier alinéa toutes instructions nécessaires pour l’exécution des tâches qu’il confie auxdits services. Il contrôle l’exécution de ces tâches.

Il peut, sous sa surveillance et sa responsabilité, donner délégation de signature aux chefs desdits services pour l’exécution des missions qu’il leur confie en application du deuxième alinéa.

Dans les conditions fixées par les conventions visées au premier alinéa, le président du conseil territorial communique chaque année au représentant de l’Etat son appréciation sur le fonctionnement des services de l’Etat mis à sa disposition.
