Article LO6461-5 of the French General Code of Local Authorities

I. – The Territorial Council may, where it has been empowered to do so at its request, by law or by decree as the case may be, adapt the legislative or regulatory provisions in force to the particular characteristics and constraints of the collectivity.

A request for authorisation to adapt a legislative or regulatory provision is adopted by reasoned deliberation of the Territorial Council.

This deliberation shall mention the legislative or regulatory provisions in question or, where the request relates to the adaptation of a regulatory provision not yet published and necessary for the application of a legislative provision, the legislative provision in question.

It sets out the particular characteristics and constraints justifying the request for empowerment and specifies the nature and purpose of the provisions that the Territorial Council intends to adopt.

The request for authorisation may not relate to a legislative or regulatory provision falling within one of the matters mentioned in the fourth paragraph of the article 74 of the Constitution.

II. – The request for authorisation lapses:

1° On the last day of the month preceding that of the normal renewal of the Territorial Council;

2° On the day of the dissolution or annulment of the election of all the members of the Territorial Council which adopted it;

3° On the day of the vacancy of all the seats on the Territorial Council other than in the cases provided for in 2°.

III. – Acts adopted pursuant to this Article are adopted by an absolute majority of the members of the Territorial Council. They may not be submitted to a local referendum or consultation of the electorate.

I. – Le conseil territorial peut, lorsqu’il y a été habilité à sa demande, par la loi ou par le décret selon le cas, adapter aux caractéristiques et aux contraintes particulières de la collectivité les dispositions législatives ou réglementaires en vigueur.

La demande d’habilitation tendant à adapter une disposition législative ou réglementaire est adoptée par délibération motivée du conseil territorial.

Cette délibération mentionne les dispositions législatives ou réglementaires en cause ou, lorsque la demande porte sur l’adaptation d’une disposition réglementaire non encore publiée et nécessaire à l’application d’une disposition législative, la disposition législative en cause.

Elle expose les caractéristiques et contraintes particulières justifiant la demande d’habilitation et précise la nature et la finalité des dispositions que le conseil territorial envisage de prendre.

La demande d’habilitation ne peut porter sur une disposition législative ou réglementaire ressortissant à l’une des matières mentionnées au quatrième alinéa de l’article 74 de la Constitution.

II. – La demande d’habilitation devient caduque :

1° Le dernier jour du mois qui précède celui du renouvellement normal du conseil territorial ;

2° Le jour de la dissolution ou de l’annulation de l’élection de l’ensemble des membres du conseil territorial qui l’a adoptée ;

3° Le jour de la vacance de l’ensemble des sièges du conseil territorial en dehors des cas prévus au 2°.

III. – Les actes pris en application du présent article sont adoptés à la majorité absolue des membres du conseil territorial. Ils ne peuvent être soumis au référendum local ou à la consultation des électeurs.
