Article LO6473-1 of the French General Code of Local Authorities

The surplus from the operating section for the financial year ended, together with the previous result carried forward, is allocated in full at the earliest budgetary decision following the vote on the administrative account and, in any event, before the close of the following financial year. The appropriation decision taken by the territorial council is produced in support of the budgetary decision to take back this result.

The deficit from the operating section, the financing requirement or the surplus from the investment section are taken back in full at the earliest budgetary decision following the vote on the administrative account and, in any event, before the end of the financial year.

Between the mandating deadline set in the last paragraph of article LO 6471-12 and the deadline for voting on local tax rates, the territorial council may, in respect of the financial year ended and before the adoption of its administrative account, carry forward to the budget the result of the operating section, the financing requirement of the investment section or, where applicable, the surplus of the investment section as well as the forecast allocation.

If the administrative account shows a difference with the amounts carried forward, the territorial council shall proceed to regularise them and to take back the result in the nearest budgetary decision following the vote on the administrative account and, in any event, before the end of the financial year.

Le résultat excédentaire de la section de fonctionnement dégagé au titre de l’exercice clos, cumulé avec le résultat antérieur reporté, est affecté en totalité dès la plus proche décision budgétaire suivant le vote du compte administratif et, en tout état de cause, avant la clôture de l’exercice suivant. La délibération d’affectation prise par le conseil territorial est produite à l’appui de la décision budgétaire de reprise de ce résultat.

Le résultat déficitaire de la section de fonctionnement, le besoin de financement ou l’excédent de la section d’investissement sont repris en totalité dès la plus proche décision budgétaire suivant le vote du compte administratif et, en tout état de cause, avant la fin de l’exercice.

Entre la date limite de mandatement fixée au dernier alinéa de l’article LO 6471-12 et la date limite de vote des taux des impositions locales, le conseil territorial peut, au titre de l’exercice clos et avant l’adoption de son compte administratif, reporter de manière anticipée au budget le résultat de la section de fonctionnement, le besoin de financement de la section d’investissement ou, le cas échéant, l’excédent de la section d’investissement ainsi que la prévision d’affectation.

Si le compte administratif fait apparaître une différence avec les montants reportés par anticipation, le conseil territorial procède à leur régularisation et à la reprise du résultat dans la plus proche décision budgétaire suivant le vote du compte administratif et, en tout état de cause, avant la fin de l’exercice.
