Article R1110-14 of the French Public Health Code

The condition of recidivism referred to in article L. 1110-3, which precludes the implementation of the conciliation procedure provided for in these same provisions, as well as that provided for in article L. 4123-2, is met when the health professional in question has already been the subject, in the six years preceding receipt of the complaint, of a definitive sanction for discriminatory refusal of care, pronounced by an Ordinary Court or by the director of a local health insurance body.

In this case, the complaint is forwarded without delay to whichever of the two authorities mentioned in the first paragraph of article R. 1110-11 has not received it. It is also forwarded, within a maximum period of three months from receipt, to the competent Ordinary Court by the President of the Council of the Association on whose roll the professional in question is registered, with his reasoned opinion and, where appropriate, by associating himself with it. The president of the council of the professional body concerned will inform the director of the local health insurance body of this transmission and subsequently of the decision handed down by the professional body.

Article R1110-14

La condition de récidive mentionnée à l’article L. 1110-3, faisant obstacle à la mise en œuvre de la procédure de conciliation prévue par ces mêmes dispositions, ainsi que de celle prévue à l’article L. 4123-2, est remplie lorsque le professionnel de santé mis en cause a déjà fait l’objet dans les six ans précédant la réception de la plainte d’une sanction définitive pour refus de soins discriminatoire, prononcée par une juridiction ordinale ou par le directeur d’un organisme local d’assurance maladie.

Dans ce cas, la plainte est transmise sans délai à celle des deux autorités mentionnées au premier alinéa de l’article R. 1110-11 qui n’en a pas été destinataire. Elle est également transmise, dans un délai maximal de trois mois à compter de sa réception, à la juridiction ordinale compétente par le président du conseil de l’ordre au tableau duquel le professionnel mis en cause est inscrit, avec son avis motivé et en s’y associant le cas échéant. Le président du conseil de l’ordre concerné informe le directeur de l’organisme local d’assurance maladie de cette transmission et ultérieurement, de la décision rendue par la juridiction ordinale.
