Article R1111-44 of the French Public Health Code

The holder of the shared medical record may authorise the digital health services and tools referenced in the digital health space to access certain data in his record under the conditions set out in III of article L. 1111-13-1 and in the fourth paragraph of article R. 1111-32. This decision may be modified at any time by the holder.

The shared medical record is accessible electronically to professionals, health establishments, social or medico-social establishments or services and authorised digital health services and tools, by means of tools and information systems which comply with the interoperability and security guidelines mentioned in article L. 1470-5, in accordance with the technical and organisational procedures defined by the Caisse nationale de l’assurance maladie.

Le titulaire du dossier médical partagé peut autoriser les services et outils numériques en santé référencés dans l’espace numérique de santé à accéder à certaines données de son dossier dans les conditions prévues au III de l’article L. 1111-13-1 et au quatrième alinéa de l’article R. 1111-32. Cette décision est modifiable à tout moment par le titulaire.

Le dossier médical partagé est accessible par voie électronique aux professionnels, aux établissements de santé, établissements ou services sociaux ou médico-sociaux et services et outils numériques en santé autorisés, au moyen d’outils et systèmes d’information qui respectent les référentiels d’interopérabilité et de sécurité mentionnés à l’article L. 1470-5, selon les modalités techniques et organisationnelles définies par la Caisse nationale de l’assurance maladie.
