The information pack provided for in article LO 1112-8 is made available to the public by the territorial authority that has decided on the local referendum at least fifteen days before the ballot.
For a referendum decided by a commune, the information pack is made available to the public at the town hall and, where applicable, in the ancillary town halls. The electors of the commune are informed by any means.
For a referendum decided by a department, a region or another territorial authority, the information file is made available to the public at the departmental or regional headquarters and in the town halls of the principal towns of the department or region. The public is informed of this availability by the insertion, at least fifteen days before the ballot, in two newspapers distributed in the department or region, of a notice including the main elements of the deliberation relating to the organisation of the referendum.
The file includes the text of the question to which the electors are asked to respond, the draft resolution or act submitted for their approval and an explanatory report setting out the reasons for and scope of the project and, where applicable, the technical and financial characteristics of its implementation. The file also contains, where applicable, notes, reports, opinions and any other documents required by law or regulation for information prior to decisions being taken by the competent territorial authorities.
It specifies that the result of the referendum will have the force of a decision and mentions the quorum and majority conditions required by the first paragraph of article LO 1112-7 for the bill to be adopted.
