Article R1112-34 of the French Public Health Code

The admission of a minor is decided, unless necessary, at the request of a person exercising parental authority or the judicial authority.

The admission of a minor who has been placed in an educational establishment or entrusted to a private individual by the judicial authority ruling on educational assistance or in application of the texts governing delinquent children, is pronounced at the request of the director of the establishment or that of the guardian.

In the case of a minor under the care of the child welfare service, admission is granted at the request of this service unless the minor has been entrusted to it by a person exercising parental authority. However, if no one exercising parental authority can be contacted in good time, admission is requested by the child welfare service.

L’admission d’un mineur est prononcée, sauf nécessité, à la demande d’une personne exerçant l’autorité parentale ou de l’autorité judiciaire.

L’admission d’un mineur, que l’autorité judiciaire, statuant en matière d’assistance éducative ou en application des textes qui régissent l’enfance délinquante, a placé dans un établissement d’éducation ou confié à un particulier, est prononcée à la demande du directeur de l’établissement ou à celle du gardien.

Lorsqu’il s’agit d’un mineur relevant du service de l’aide sociale à l’enfance, l’admission est prononcée à la demande de ce service sauf si le mineur lui a été confié par une personne exerçant l’autorité parentale. Toutefois, lorsque aucune personne exerçant l’autorité parentale ne peut être jointe en temps utile, l’admission est demandée par le service d’aide sociale à l’enfance.
