Article R1113-1 of the French Public Health Code

Any person admitted to or accommodated in an establishment referred to in article L. 1113-1 is invited, on admission, to deposit the movable items whose nature justifies their detention during their stay in the establishment.

On this occasion, written and oral information is given to the person admitted or accommodated, or to their legal representative in the case of a minor or, if the person is the subject of a legal protection measure with representation relating to the person, to the person responsible for the measure. This information refers to this chapter and includes a statement of the rules relating to the property held by persons admitted or accommodated in the establishment. It specifies the principles governing the liability of the establishment or of the State for army hospitals in the event of theft, loss or deterioration of such property, depending on whether or not it has been deposited, as well as the fate of unclaimed or abandoned items in these establishments. Where applicable, this information is also included in the establishment’s internal regulations.

The person admitted or accommodated, or their legal representative in the case of a minor or, where applicable, the person in charge of the legal protection measure with representation relating to the person, certifies that they have received the information provided for in the previous paragraph. The establishment will keep a record of this declaration.

Toute personne admise ou hébergée dans un établissement mentionné à l’article L. 1113-1 est invitée, lors de son entrée, à effectuer le dépôt des choses mobilières dont la nature justifie la détention durant son séjour dans l’établissement.

A cette occasion, une information écrite et orale est donnée à la personne admise ou hébergée, ou à son représentant légal s’il s’agit d’un mineur ou, si la personne fait l’objet d’une mesure de protection juridique avec représentation relative à la personne, à la personne chargée de la mesure. Cette information fait référence au présent chapitre et comprend l’exposé des règles relatives aux biens détenus par les personnes admises ou hébergées dans l’établissement. Elle précise les principes gouvernant la responsabilité de celui-ci ou de l’Etat pour les hôpitaux des armées en cas de vol, perte ou détérioration de ces biens, selon qu’ils ont ou non été déposés, ainsi que le sort réservé aux objets non réclamés ou abandonnés dans ces établissements. Cette information figure aussi, le cas échéant, dans le règlement intérieur de l’établissement.

La personne admise ou hébergée, ou son représentant légal s’il s’agit d’un mineur ou, le cas échéant, la personne chargée de la mesure de protection juridique avec représentation relative à la personne, certifie avoir reçu l’information prévue à l’alinéa précédent. Mention de cette déclaration est conservée par l’établissement.
