The contracts mentioned in article R. 1121-4 may only include clauses excluding cover for damage suffered by victims or their dependants in the following cases:
1° The research does not take place under the conditions set out in the second and third paragraphs of article L. 1121-3, as approved by the Committee for the Protection of Individuals pursuant to article L. 1123-7 and, where applicable, by the French National Agency for the Safety of Medicines and Health Products ;
2° The consent of the persons taking part in the research is not obtained under the conditions set out in articles L. 1122-1-1, L. 1122-1-3 or L. 1122-2 ;
3° The research is carried out without the favourable opinion of the Committee for the Protection of Individuals and, where applicable, the authorisation of the competent authority provided for in Articles L. 1123-6 and L. 1123-8 having been obtained;
4° The provisions of article L. 1121-13 have not been complied with;
5° The research is carried out despite a prohibition or suspension decision taken by the competent authority mentioned in article L. 1123-12.
