Article R1123-49 of the French Public Health Code

The investigator notifies the sponsor without delay from the day on which he becomes aware of all serious adverse events and all adverse reactions and serious incidents occurring in the course of research mentioned in 1° of Article L. 1121-1, with the exception of those identified in the protocol or in the brochure for the investigator as not requiring immediate notification. The investigator notifies these events within an appropriate timeframe, taking into account the specific nature of the research and the serious adverse event, as well as any indications given in the protocol or the investigator’s brochure. This notification is the subject of a written report and is followed by further detailed written reports.

For the research mentioned in 1° of Article L. 1121-1, the investigator notifies the sponsor of the adverse events and the results of abnormal medical biology examinations defined in the protocol as being decisive for the evaluation of the safety of the persons taking part in the research, in accordance with the notification requirements defined in the protocol and within the time limits specified therein.

In the notifications and in subsequent reports, the persons involved in the research are identified by a code number.

The investigator provides the sponsor with additional information concerning serious adverse events.

L’investigateur notifie au promoteur sans délai à compter du jour où il en a connaissance tous les événements indésirables graves ainsi que tous les effets indésirables et les incidents graves survenus au cours d’une recherche mentionnée au 1° de l’article L. 1121-1, à l’exception de ceux qui sont recensés dans le protocole ou dans la brochure pour l’investigateur comme ne nécessitant pas une notification sans délai. L’investigateur notifie ces événements dans un délai approprié en tenant compte des spécificités de la recherche et de l’événement indésirable grave ainsi que d’éventuelles indications figurant dans le protocole ou la brochure pour l’investigateur. Cette notification fait l’objet d’un rapport écrit et est suivie de rapports complémentaires écrits détaillés.

Pour les recherches mentionnées au 1° de l’article L. 1121-1, l’investigateur notifie au promoteur les événements indésirables et les résultats d’examens de biologie médicale anormaux définis dans le protocole comme déterminants pour l’évaluation de la sécurité des personnes qui se prêtent à la recherche, conformément aux exigences de notification définies dans le protocole et dans les délais spécifiés par celui-ci.

Dans les notifications comme dans les rapports ultérieurs, les personnes qui se prêtent à la recherche sont identifiées par un numéro de code.

L’investigateur communique au promoteur des informations complémentaires concernant les événements indésirables graves.
