Article R1132-5-2 of the French Public Health Code

The implementation of the provisions of Article R. 1132-5-1 is subject to the establishment of an organisational protocol between the qualified medical practitioner in genetics and the genetic counsellor placed under his responsibility. This protocol specifies in particular:

1° The general conditions of intervention of the genetic counsellor within the multidisciplinary team;

2° The procedures for the transmission of information between the genetic counsellor and the qualified medical practitioner in genetics under whose responsibility he/she works;

3° The cases, defined in particular according to the nature of the examinations, the pathologies or the situation of the persons concerned, in which the genetic counsellor may prescribe the medical biology examinations mentioned in Article R. 1132-5-1;

4° The situations in which the genetic counsellor may communicate the results of the examinations mentioned in 3° to the persons concerned;

5° The procedures for informing the persons concerned of the conditions of their care;

6° The procedures and deadlines for its revision.

All members of the multidisciplinary team are informed of the organisational protocol.

La mise en œuvre des dispositions de l’article R. 1132-5-1 est subordonnée à l’établissement d’un protocole d’organisation entre le médecin qualifié en génétique et le conseiller en génétique placé sous sa responsabilité. Ce protocole précise notamment :


1° Les conditions générales d’intervention du conseiller en génétique au sein de l’équipe pluridisciplinaire ;


2° Les modalités de transmission d’informations entre le conseiller en génétique et le médecin qualifié en génétique sous la responsabilité duquel il exerce ;


3° Les cas, définis notamment en fonction de la nature des examens, des pathologies ou de la situation des personnes concernées, dans lesquels le conseiller en génétique peut prescrire les examens de biologie médicale mentionnés à l’article R. 1132-5-1 ;


4° Les situations dans lesquelles le conseiller en génétique peut communiquer aux personnes concernées les résultats des examens mentionnés au 3° ;


5° Les modalités d’information des personnes concernées sur leurs conditions de prise en charge ;


6° Ses modalités et délais de révision.


Le protocole d’organisation est porté à la connaissance de l’ensemble des membres de l’équipe pluridisciplinaire.
