The Commission defined in article L. 1142-5 has jurisdiction over a region or regions designated by the order mentioned in the second paragraph of the same article. This order specifies the region in which the Commission has its registered office.
However, several commissions may be set up in the same region, by order of the ministers responsible for health, social security and the budget, to take account of the number of claims submitted to the existing regional commission, the number of inhabitants in the region and the number of professionals, establishments, services and organisations mentioned in article L. 1142-1. The commission’s jurisdiction then includes one or more départements.
The decree specifies the jurisdiction and the date on which the new commissions take up their duties. Claims referred to the regional commission on this date will continue to be examined by the new commission responsible for each claim, by virtue of the first paragraph of article R. 1142-13. The period referred to in Article L. 1142-8 runs from the date of referral to the Regional Commission.
