Article R1161-12 of the French Public Health Code

The authorisation of the learning programme covers the elements of the programme, the procedures for its implementation and the choice of operator.

It is subject to the following conditions:

1° The existence of a benefit for a patient suffering from a medical condition whose medicinal treatment requires technical gestures, particularly in the case of chronic treatment;

2° The appropriateness of the programme to the requirements of learning the technical gesture, having regard to the duration of the programme and the resources implemented;

3° The educational and non-promotional nature of the programme;

4° Compliance with the provisions of articles R. 1161-10, R. 1161-11, R. 1161-13 and R. 1161-14;

5° A commitment to comply with the conditions relating to the operator as defined in article R. 1161-24.

L’autorisation du programme d’apprentissage porte sur les éléments du programme, sur les modalités de sa mise en œuvre, ainsi que sur le choix de l’opérateur.


Elle est subordonnée aux conditions suivantes :


1° L’existence d’un bénéfice pour un patient atteint d’une pathologie dont le traitement médicamenteux nécessite des gestes techniques, notamment lorsqu’il s’agit d’un traitement chronique ;


2° L’adéquation du programme à ce qu’exige l’apprentissage du geste technique, eu égard à la durée de ce programme et aux moyens mis en œuvre ;


3° Le caractère pédagogique et non promotionnel du programme ;


4° Le respect des dispositions des articles R. 1161-10, R. 1161-11, R. 1161-13 et R. 1161-14 ;


5° L’engagement à respecter les conditions relatives à l’opérateur telles que définies à l’article R. 1161-24.
