Article R1213-22 of the French General Code of Local Authorities

The Board may only validly deliberate when, in addition to the Chairman or one of the Vice-Chairmen, two of the members mentioned in 1° to 6° of article L. 1212-1 and two of the members mentioned in 7° of the same article.

If this quorum is not reached, the Board is immediately convened with the same agenda. It shall then validly deliberate regardless of the number of members present or taking part in the debates.

If the Chairman and his three Vice-Chairmen are unable to chair a meeting of the Council, and this is ascertained less than seven days before the day of the meeting, the Chairman shall appoint a Chairman for the meeting from among the members mentioned in 3° to 6° of II of Article L. 1212-1, after informing the three Vice-Chairmen.

The deliberations of the National Council shall be adopted by a simple majority of the votes cast. In the event of a tie, the chairman has the casting vote.

Le conseil ne peut valablement délibérer que lorsque sont présents ou prennent part aux débats au moyen d’une conférence téléphonique ou télévisuelle, outre le président ou l’un des vice-présidents, deux des membres mentionnés aux 1° à 6° de l’article L. 1212-1 et deux des membres mentionnés au 7° du même article.

Si ce quorum n’est pas atteint, le conseil est aussitôt convoqué avec le même ordre du jour. Il délibère alors valablement quel que soit le nombre de membres présents ou prenant part aux débats.

En cas d’impossibilité pour le président et ses trois vice-présidents de présider une séance du Conseil, constatée moins de sept jours avant le jour de la séance, le président désigne un président de séance parmi les membres mentionnés aux 3° à 6° du II de l’article L. 1212-1, après en avoir informé les trois vice-présidents.

Les délibérations du conseil national sont adoptées à la majorité simple des suffrages exprimés. En cas de partage, la voix du président est prépondérante.
