Article R122-31 of the French Intellectual Property Code

I.-Publicly accessible libraries, museums, archive services or institutions holding film, audiovisual or sound heritage wishing to exploit unavailable works under the conditions mentioned in the first paragraph of I of article L. 122-5-5 shall publish the following information in advance on their website, in a dedicated and identifiable section:

-the terms of the reasonable investigative efforts made by the institution to determine whether a work is available to the public through the usual commercial distribution channels;

the procedures for exercising the right to object referred to in article R. 122-32;

> -the contact details of the EPO portal
-the contact details for the portal of the European Union Intellectual Property Office;

II.-The institutions mentioned in I shall publish without delay on their website the list of works for which they are undertaking reasonable efforts of investigation in order to establish their unavailability.

Article R122-31

I.-Les bibliothèques accessibles au public, les musées, les services d’archives ou les institutions dépositaires du patrimoine cinématographique, audiovisuel ou sonore souhaitant exploiter des œuvres indisponibles dans les conditions mentionnées au premier alinéa du I de l’article L. 122-5-5 publient préalablement sur leur site internet, au sein d’une rubrique dédiée et identifiable, les informations suivantes :

-les modalités des efforts raisonnables d’investigation accomplis par l’institution pour déterminer si une œuvre est disponible pour le public par le biais des circuits de distribution commerciaux habituels ;

-les modalités d’exercice du droit d’opposition mentionnées à l’article R. 122-32 ;

-les coordonnées du portail de l’Office de l’Union européenne pour la propriété intellectuelle.

II.-Les institutions mentionnées au I publient sans délai sur leur site internet la liste des œuvres pour lesquelles elles engagent des efforts raisonnables d’investigation afin d’établir leur indisponibilité.
