Article R1221-49 of the French Public Health Code

I. – Any healthcare professional who observes or has knowledge of a serious incident shall report it without delay to the haemovigilance and transfusion safety correspondent of the establishment where the incident took place or to that of the establishment in which the incident was discovered. If he is unable to identify the incident, he will report it to any haemovigilance and transfusion safety correspondent in a blood establishment or health establishment, who will forward this information to the relevant haemovigilance and transfusion safety correspondent.

II. – The haemovigilance and transfusion safety correspondent carries out the appropriate investigations and examinations. He/she draws up a serious incident report form when the incident only concerns his/her establishment.

III. – When the incident concerns both a blood establishment and a healthcare establishment, the haemovigilance and transfusion safety correspondent, who has carried out the investigations, informs the correspondent of the other establishment and, in consultation with him/her, draws up a serious incident report form.

Article R1221-49

I. – Tout professionnel de santé qui constate ou a connaissance d’un incident grave le signale sans délai au correspondant d’hémovigilance et de sécurité transfusionnelle de l’établissement où l’incident a eu lieu ou à celui de l’établissement dans lequel l’incident a été découvert. A défaut de pouvoir l’identifier, il le signale à tout correspondant d’hémovigilance et de sécurité transfusionnelle d’un établissement de transfusion sanguine ou d’un établissement de santé, qui transmet cette information au correspondant d’hémovigilance et de sécurité transfusionnelle compétent.

II. – Le correspondant d’hémovigilance et de sécurité transfusionnelle procède aux investigations et examens appropriés. Il rédige une fiche de déclaration d’incident grave lorsque l’incident ne concerne que son établissement.

III. – Lorsque l’incident concerne à la fois un établissement de transfusion sanguine et un établissement de santé, le correspondant d’hémovigilance et de sécurité transfusionnelle, qui a procédé aux investigations, informe le correspondant de l’autre établissement et rédige, en concertation avec lui, une fiche de déclaration d’incident grave.
