Article R1221-73 of the French Public Health Code

The Office will decide on the compensation claim within six months of the date on which it receives a complete file, by registered letter with acknowledgement of receipt.

The decisions of the Office rejecting the claim for compensation in whole or in part shall state the reasons on which they are based.

Silence on the part of the Office during the period referred to in the first paragraph will result in an implicit rejection decision.

L’office se prononce sur la demande d’indemnisation, dans un délai de six mois à compter du jour où il a reçu un dossier complet, par lettre recommandée avec demande d’avis de réception.


Les décisions de l’office rejetant totalement ou partiellement la demande d’indemnisation sont motivées.


Le silence gardé par l’office pendant le délai mentionné au premier alinéa fait naître une décision implicite de rejet.
