Article R123-128 of the French Commercial code

Any trader is automatically struck off the register if:

1° He is prohibited from carrying on a commercial activity by virtue of a court decision that has become final or an enforceable administrative decision;

2° He has been deceased for more than one year, unless a declaration has been made under the conditions provided for in 6° and 7° of article R. 123-46. In the latter case, deregistration is carried out within one year of the declaration or its renewal being mentioned; notification is given to the operator with an invitation to apply for registration.

In application of the first two paragraphs of article L. 613-4 of the Social Security Code , any trader who is no longer affiliated to this body in his capacity as a self-employed worker is also struck off automatically, as soon as the Registrar is informed of the striking off ordered by a social security body.

Est radié d’office tout commerçant :

1° Frappé d’une interdiction d’exercer une activité commerciale en vertu d’une décision judiciaire passée en force de chose jugée ou d’une décision administrative exécutoire ;

2° Décédé depuis plus d’un an, sauf déclaration faite dans les conditions prévues aux 6° et 7° de l’article R. 123-46. Dans ce dernier cas, la radiation est faite dans le délai d’un an à compter de la mention de la déclaration ou de son renouvellement ; notification en est faite à l’exploitant avec invitation d’avoir à requérir son immatriculation.

En application des deux premiers alinéas de l’article L. 613-4 du code de la sécurité sociale , est également radié d’office, dès que le greffier est informé de la radiation prononcée par un organisme de sécurité sociale, tout commerçant qui n’est plus affilié à cet organisme en sa qualité de travailleur indépendant.
