Article R123-251 of the French Commercial code

The following must be filed by the natural person in the appendix to the National Register of Companies:

1° A copy of the business project support contract for the creation or takeover of an economic activity concluded under the conditions set out in Chapter VII of Title II of this book;

2° At the time of his application for registration, a certificate of delivery of the information given to his spouse with joint property on the consequences of debts contracted in the exercise of his profession on joint property, drawn up in accordance with a model defined by order of the Minister of Justice;

3° In the case of affected assets within the meaning of Article L. 526-6, the descriptive statement provided for in Article L. 526-8 and, where applicable, the documents attesting to completion of the formalities provided for in Articles L. 526-9 and L. 526-11 and, within six months of the close of the financial year, the accounting documents referred to in Article L. 526-14.

Font l’objet d’un dépôt par la personne physique, en annexe du Registre national des entreprises, les éléments suivants :

1° Une copie du contrat d’appui au projet d’entreprise pour la création ou la reprise d’une activité économique conclu dans les conditions prévues au chapitre VII du titre II du présent livre ;

2° Lors de sa demande d’immatriculation, une attestation de délivrance de l’information donnée à son conjoint commun en biens sur les conséquences des dettes contractées dans l’exercice de sa profession sur les biens communs, établie conformément à un modèle défini par arrêté du garde des sceaux, ministre de la justice ;

3° En présence d’un patrimoine affecté au sens de l’article L. 526-6, l’état descriptif prévu à l’article L. 526-8 ainsi que, s’il y a lieu, les documents attestant de l’accomplissement des formalités prévues aux articles L. 526-9 et L. 526-11 et, dans le délai de six mois suivant la clôture de l’exercice, les documents comptables mentionnés à l’article L. 526-14.
