Article R123-280 of the French Commercial code

In the event of changes to the information or justification made pursuant to Article R. 123-279, the person registered in the National Register of Companies as a business in the trades and crafts sector pursuant to 3° of Article L. 123-36 shall indicate:

1° Within a period of one month, the crossing of the threshold of two hundred and fifty employees mentioned in the third paragraph of article 19 of law no. 96-603 of 5 July 1996 relating to the development and promotion of commerce and craft trades;

2° Within a period of three months, in the event of a change in circumstances affecting the obligations of registered persons with regard to professional qualifications as provided for by the article 16 of law no. 96-603 of 5 July 1996 relating to the development and promotion of trade and craft trades, the identity and position within the business of the person exercising effective and permanent control of the business as well as the supporting documents provided for in 3° of article R. 123-279;

3° Within a period of six months, in the event of the holder of the certificate of competence leaving within a river freight transport company, the identity and capacity of the new holder of the certificate of competence. This period is extended to one year, extendable by a maximum of six months, in the event of the death or physical or legal incapacity of the holder of the certificate of competence, in accordance with the first paragraph of article R. 4421-5 of the Transport Code. The declaration is accompanied by the certificate provided for in article R. 4421-4 of the same code.

En cas de modifications des informations ou justification réalisées en application de l’article R. 123-279, la personne immatriculée au Registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat en application du 3° de l’article L. 123-36 indique :

1° Dans le délai d’un mois, le passage au seuil de deux-cent-cinquante salariés mentionné au troisième alinéa de l’article 19 de la loi n° 96-603 du 5 juillet 1996 relative au développement et à la promotion du commerce et de l’artisanat ;

2° Dans le délai de trois mois, en cas de changement de situation affectant les obligations des personnes immatriculées en matière de qualification professionnelle prévues par l’article 16 de la loi n° 96-603 du 5 juillet 1996 relative au développement et à la promotion du commerce et de l’artisanat, l’identité et la qualité au sein de l’entreprise de la personne exerçant le contrôle effectif et permanent de l’activité ainsi que les pièces justificatives prévues au 3° de l’article R. 123-279 ;

3° Dans le délai de six mois, en cas de départ du titulaire de l’attestation de capacité au sein d’une entreprise de transport fluvial de marchandises, l’identité et la qualité du nouveau titulaire de l’attestation de capacité. Ce délai est porté à un an, prorogeable de six mois au plus, en cas de décès ou d’incapacité physique ou légale de la personne titulaire de l’attestation de capacité, conformément au premier alinéa de l’article R. 4421-5 du code des transports. La déclaration est accompagnée de l’attestation prévue à l’article R. 4421-4 du même code.
