Article R123-284 of the French Commercial code

The validation of information entries and document filings provided for in Article L. 123-48 and the checks provided for in Article L. 123-49 are carried out by the departmental or multi-departmental mutualité sociale agricole fund whose jurisdiction is determined in accordance with the rules established by Articles R. 722-16 and D. 731-14 of the Rural and Maritime Fishing Code.

When a natural or legal person transfers their main business or registered office to the jurisdiction of a fund other than the one to which they are affiliated, they declare this transfer, under the conditions set out in Article R. 123-6, to the single body mentioned in Article R. 123-1, which informs the affiliated fund under the conditions set out in Article R. 123-7, under the same conditions. After carrying out the validation operations, the latter immediately informs the originating fund by any means available.

The originating fund will be informed of the validation operations carried out.

La validation des inscriptions d’informations et des dépôts de pièces prévue à l’article L. 123-48 et les contrôles prévus à l’article L. 123-49 sont réalisés par la caisse départementale ou pluridépartementale de mutualité sociale agricole dont la compétence est déterminée selon les règles établies par les articles R. 722-16 et D. 731-14 du code rural et de la pêche maritime.

Lorsqu’une personne physique ou morale transfère sa principale exploitation ou son siège dans le ressort d’une autre caisse que celle dont elle relève, elle déclare ce transfert, dans les conditions prévues à l’article R. 123-6, à l’organisme unique mentionné à l’article R. 123-1, lequel en informe, dans les conditions prévues à l’article R. 123-7, la caisse de rattachement dans les mêmes conditions. Après avoir procédé aux opérations de validation, cette dernière en informe sans délai et par tout moyen la caisse d’origine.
