Article R123-45 of the French Commercial code

Any modification making it necessary to rectify or add to the statements provided for in articles R. 123-37, R. 123-38, R. 123-42 and R. 123-44 shall, within one month, be the subject of an application for amending registration.

Subject to the provisions of Article R. 123-89, this application is submitted by the trader or, in the event of death, by the persons mentioned in 7° of article R. 123-46.

The application relating to assets assigned to a professional activity is submitted to the single body by the person entered in the register or by the persons mentioned in articles L. 526-15 and L. 526-17, using the same procedure. The application relating to the transfer to a sole trader or a legal entity of the earmarked assets, or to their contribution to a company, is submitted by the transferor or contributor to the single body.

Toute modification rendant nécessaire une rectification ou une adjonction aux énonciations prévues aux articles R. 123-37, R. 123-38, R. 123-42 et R. 123-44 fait, dans le délai d’un mois, l’objet d’une demande d’inscription modificative.

Sous réserve des dispositions de l’article R. 123-89, cette demande est présentée par le commerçant ou, en cas de décès, par les personnes mentionnées au 7° de l’article R. 123-46.

La demande relative à un patrimoine affecté à une activité professionnelle est présentée auprès de l’organisme unique par la personne immatriculée au registre ou par les personnes mentionnées aux articles L. 526-15 et L. 526-17, selon le même procédé. La demande relative à la cession à un entrepreneur individuel ou à une personne morale du patrimoine affecté, ou à son apport en société, est présentée par le cédant ou l’apporteur auprès de l’organisme unique.
