To be authorised to take tissue samples for therapeutic purposes from a deceased person, health establishments must :
1° Demonstrate that their organisation and operating conditions are such that retrieval operations can be carried out satisfactorily;
2° Appoint a medical coordinator for the retrieval activity, after consultation with the establishment’s medical advisory body, and one or, where appropriate, hospital coordinators, nurses; the list of these persons is communicated to the health establishment’s decision-making body; the medical coordinator for the retrieval activity and the hospital coordinator(s) may be the same as those provided for in article R. 1233-7 ;
3° Have at their disposal, either directly or through agreements with other health establishments or establishments or organisations authorised in application of article L. 1243-2, medical staff qualified to carry out surgical sampling procedures and other staff, in sufficient numbers to carry out this activity;
4° Have the premises required to carry out this activity and at least :
a) A room suitable for receiving families; where appropriate, this room may be the same as that provided for in 5° a of Article R. 1233-7 ;
b) An isolated sampling room equipped in accordance with the rules of good practice set out in Article L. 1245-6;
5° Demonstrate and be able to provide, for each type of tissue removed, the material resources necessary for the decent restoration of the body;
6° Demonstrate that it is organised in such a way as to ensure, or have ensured, satisfactory transport of the tissues removed in conjunction with the establishments or organisations authorised in application of the provisions of articles L. 1243-2, L. 4211-9-1, L. 4211-9-2, L. 5124-1 or L. 5124-9-1.
