Article R1261-15 of the French Public Health Code

The special purpose vehicle is managed by a manager appointed in accordance with the conditions laid down in its articles of association.

When the special purpose vehicle is set up in a public scientific, cultural and professional establishment, its manager belongs to one of the bodies of teacher-researchers working in the establishment or assimilated staff pursuant to article 5 of decree no. 87-31 of 20 January 1987 relating to the National Council of Universities for health disciplines and article 6 of decree no. 92-70 of 16 January 1992 as amended relating to the National Council of Universities.

When the structure for receiving the bodies is created in a health establishment, the person in charge is appointed from among the teaching and hospital staff mentioned in articles L. 6151-1 to L. 6151-3 of this code. In addition, when the structure is created in accordance with the third paragraph of article R. 1261-11, the person in charge may be appointed from among the staff of the associated institution belonging to one of the bodies of teacher-researchers mentioned in the previous paragraph.

He is assisted by an ethics, scientific and pedagogical committee, of which he may not be a member, and, if necessary, by a deputy that he appoints.

La structure d’accueil des corps est dirigée par un responsable désigné dans les conditions prévues par ses statuts.

Lorsque la structure d’accueil des corps est créée dans un établissement public à caractère scientifique, culturel et professionnel, son responsable appartient à l’un des corps d’enseignants-chercheurs en fonction dans l’établissement ou des personnels assimilés en application de l’article 5 du décret n° 87-31 du 20 janvier 1987 relatif au Conseil national des universités pour les disciplines de santé et de l’article 6 du décret du n° 92-70 du 16 janvier 1992 modifié relatif au Conseil national des universités.

Lorsque la structure d’accueil des corps est créée dans un établissement de santé, le responsable est désigné parmi les personnels enseignants et hospitaliers mentionnés aux articles L. 6151-1 à L. 6151-3 du présent code. En outre, lorsque la structure est créée conformément au troisième alinéa de l’article R. 1261-11, le responsable peut être désigné parmi les personnels de l’établissement associé appartenant à l’un des corps d’enseignants-chercheurs mentionnés à l’alinéa précédent.

Il est assisté par un comité d’éthique, scientifique et pédagogique, dont il ne peut être membre, et, le cas échéant, par un adjoint qu’il désigne.
