Article R131-2 of the French Commercial code

The public prosecutor examines the application for registration. He checks that the applicant meets the required conditions and gathers all information on the merits of the application.

He forwards the application to the Conseil national des courtiers de marchandises assermentés for its opinion by registered letter with acknowledgement of receipt.

If, forty-five days after the matter has been referred to it, the Council has not sent its opinion to the Public Prosecutor, it is deemed to be favourable.

Le procureur général instruit la demande d’inscription. Il vérifie que le candidat remplit les conditions requises et recueille tous renseignements sur les mérites de celle-ci.


Il transmet la demande pour avis au Conseil national des courtiers de marchandises assermentés par lettre recommandée avec demande d’avis de réception.


Si, quarante-cinq jours après sa saisine, le Conseil n’a pas adressé au procureur général son avis, celui-ci est tenu pour favorable.
