Article R131-7 of the French Commercial code

The guarantee provided for in 3° of Article L. 131-15 may only be granted by one of the credit institutions or finance companies authorised for this purpose or one of the institutions or establishments mentioned in Article L. 518-1 of the Monetary and Financial Code, an insurance company or a mutual guarantee company, authorised to give guarantees.

The guarantee is the result of a written agreement which, in addition to the general terms and conditions, specifies in particular the amount of the guarantee granted, the terms of remuneration, the accounting control procedures and any counter-guarantees required by the guarantor.

Le cautionnement prévu au 3° de l’article L. 131-15 ne peut être consenti que par l’un des établissements de crédit ou l’une des sociétés de financement habilités à cet effet ou l’une des institutions ou l’un des établissements mentionnés à l’article L. 518-1 du code monétaire et financier, une société d’assurances ou une société de caution mutuelle, habilités à donner caution.


Le cautionnement résulte d’une convention écrite qui, outre les conditions générales, précise notamment le montant de la garantie accordée, les conditions de rémunération, les modalités de contrôle comptable ainsi que les contre-garanties éventuellement exigées par la caution.
