Article R1311-1 of the French General Code of Local Authorities

The annual amount of rent, above which any draft emphyteutic administrative lease presented for the completion of an operation of general interest linked to the needs of the justice system, the police or the national gendarmerie is subject to the completion of a prior assessment pursuant to the third paragraph of Article L. 1311-2, is set at one million euros excluding tax.

The methods of financing the cost of the assessment referred to in the previous paragraph are set out in an agreement between the State and the local authority, grouping or public establishment that owns the property that is the subject of the administrative long lease.

Article R1311-1

Le montant annuel du loyer, au-delà duquel tout projet de bail emphytéotique administratif présenté pour la réalisation d’une opération d’intérêt général liée aux besoins de la justice, de la police ou de la gendarmerie nationales est soumis à la réalisation d’une évaluation préalable en vertu du troisième alinéa de l’article L. 1311-2, est fixé à un million d’euros hors taxes.

Les modalités de financement du coût de l’évaluation mentionnée à l’alinéa précédent sont fixées par une convention conclue entre l’Etat et la collectivité territoriale, le groupement ou l’établissement public propriétaire du bien faisant l’objet du bail emphytéotique administratif.
