Article R1311-7 of the French General Code of Local Authorities

The competent State authority obtains the opinion of the local authority that owns the domain before issuing authorisations and declaration receipts under the various policies falling within its remit.

The watercourses, canals, lakes and bodies of water in the territorial public river domain that are open to navigation must be the subject of special navigation police regulations issued by the State representative, on the proposal of the local authority in accordance with article R. 4241-66 of the Transport Code.

L’autorité compétente de l’Etat recueille l’avis de la collectivité propriétaire du domaine avant de délivrer les autorisations et les récépissés de déclaration au titre des différentes polices relevant de ses attributions.

Les cours d’eau, canaux, lacs et plan d’eau du domaine public fluvial territorial ouverts à la navigation doivent faire l’objet d’un règlement particulier de police de la navigation pris par le représentant de l’Etat, sur proposition de la collectivité conformément à l’article R. 4241-66 du code des transports.
