Article R1321-26 of the French Public Health Code

Without prejudice to the provisions of article R. 1321-47, if the quality limits defined by the order mentioned in article R. 1321-2 are not complied with at the points of compliance defined in article R. 1321-5, the person responsible for producing or distributing water intended for human consumption must:

1° Immediately inform the mayor and the director general of the regional health agency, who will forward this information to the territorially competent prefect;

2° Immediately carry out an investigation to determine the cause;

3° Immediately report the findings and conclusions of the investigation to the authorities mentioned in 1° of this article.

For packaged water, the provisions applicable are those of article R. 1322-44-6.

Article R1321-26

Sans préjudice des dispositions prévues à l’article R. 1321-47, si les limites de qualité définies par l’arrêté mentionné à l’article R. 1321-2, ne sont pas respectées aux points de conformité définis à l’article R. 1321-5, la personne responsable de la production ou de la distribution d’eau destinée à la consommation humaine est tenue :

1° D’en informer immédiatement le maire et le directeur général de l’agence régionale de santé, qui transmet cette information au préfet territorialement compétent ;

2° D’effectuer immédiatement une enquête afin d’en déterminer la cause ;

3° De porter immédiatement les constatations et les conclusions de l’enquête aux autorités mentionnées au 1° du présent article.

Pour les eaux conditionnées, les dispositions applicables sont celles de l’article R. 1322-44-6.
