Article R1321-7 of the French Public Health Code

I.-The Prefect submits a summary report drawn up by the Director General of the Regional Health Agency and a reasoned draft order to the Departmental Council for the Environment and Health and Technological Risks for its opinion.

The Prefect sends the draft order to the applicant and informs him of the date and location of the meeting of the Departmental Council. The applicant or his representative may ask to be heard by the departmental council or submit written observations.

If the installations are located in different départements, the prefects of these départements choose the prefect to coordinate the procedure.

II – In the event of an exceptional risk or situation, the Prefect may also send the application file and the summary report referred to in I to the Minister for Health, who may forward them to the National Agency for Food, Environmental and Occupational Health Safety for an opinion.

The provisions of this II do not apply to spring water as defined in article R. 1321-84.

I.-Le préfet soumet un rapport de synthèse établi par le directeur général de l’agence régionale de santé et un projet d’arrêté motivé à l’avis du conseil départemental de l’environnement et des risques sanitaires et technologiques.

Le préfet transmet le projet d’arrêté au demandeur et l’informe de la date et du lieu de la réunion du conseil départemental. Le demandeur ou son mandataire peut demander à être entendu par le conseil départemental ou lui présenter ses observations écrites.

Dans le cas où les installations sont situées dans des départements différents, les préfets de ces départements choisissent le préfet coordonnateur de la procédure.

II.-Le préfet peut également, en cas de risque ou de situation exceptionnels, adresser le dossier de la demande, ainsi que le rapport de synthèse mentionné au I, au ministre chargé de la santé, qui peut les transmettre pour avis à l’Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail.

Les dispositions du présent II ne s’appliquent pas aux eaux de source définies à l’article R. 1321-84.
