Article R1322-44-21 of the French Public Health Code

The holder of an import authorisation must immediately notify the Prefect of any changes to the operating conditions.

The Prefect who issued the authorisation to import a natural mineral water may, in the event of a variation in the quality of the water observed by the control authorities or reported by the authorisation holder and if this water presents a danger to public health or no longer meets the regulatory quality requirements, suspend, by a reasoned decision, its marketing for a maximum period of four months. It informs the Minister for Health of this decision for notification to the European Commission.

At the end of this period, the authorisation may be withdrawn by the Prefect.

Le titulaire d’une autorisation d’importation doit immédiatement signaler au préfet toute modification apportée aux conditions d’exploitation.

Le préfet ayant délivré l’autorisation d’importer une eau minérale naturelle peut, en cas de variation de la qualité de l’eau constatée par les autorités de contrôle ou signalée par le titulaire de l’autorisation et si cette eau présente un danger pour la santé publique ou ne répond plus aux exigences de qualité réglementaires suspendre, par une décision motivée, sa commercialisation pour une durée maximum de quatre mois. Il informe le ministre chargé de la santé de cette décision aux fins de notification à la Commission européenne.

A l’issue de ce délai, l’autorisation peut être retirée par le préfet.
