Article R1323-1 of the French Public Health Code

I. – The purpose of food vigilance, known as nutrivigilance, is to monitor, assess and prevent the risk of undesirable effects linked to the consumption of the foodstuffs and foods mentioned in II of this article.

II. – Nutrivigilance is carried out on :

1° Novel foods within the meaning of Article 2 of Regulation (EU) No 2015/2283 of the European Parliament and of the Council of 25 November 2015 on novel foods ;

2° Foods to which substances for nutritional or physiological purposes are added within the meaning of Articles 1 and 2 of Regulation (EC) No 1925/2006 on the addition of vitamins and minerals and of certain other substances to foods;

3° Food supplements within the meaning of Article 2 of Decree No. 2006-352 of 20 March 2006 on food supplements;

4° Foodstuffs covered by Regulation (EU) No 609/2013 of the European Parliament and of the Council of 12 June 2013 on foodstuffs intended for infants and young children, foodstuffs intended for special medical purposes and total daily ration substitutes for weight control.

Article R1323-1

I. – La vigilance alimentaire, dite nutrivigilance, a pour objet la surveillance, l’évaluation, la prévention du risque d’effet indésirable lié à l’absorption des denrées et aliments mentionnés au II du présent article.

II. – La nutrivigilance s’exerce sur :

1° Les nouveaux aliments au sens de l’article 2 du règlement (UE) n° 2015/2283 du Parlement européen et du Conseil du 25 novembre 2015 relatif aux nouveaux aliments ;

2° Les aliments qui font l’objet d’adjonction de substances à but nutritionnel ou physiologique au sens des articles 1er et 2 du règlement (CE) n° 1925/2006 concernant l’adjonction de vitamines, de minéraux et de certaines autres substances aux denrées alimentaires ;

3° Les compléments alimentaires au sens de l’article 2 du décret n° 2006-352 du 20 mars 2006 relatif aux compléments alimentaires ;

4° Les denrées alimentaires couvertes par le règlement (UE) n° 609/2013 du Parlement européen et du Conseil du 12 juin 2013 concernant les denrées alimentaires destinées aux nourrissons et aux enfants en bas âge, les denrées alimentaires destinées à des fins médicales spéciales et les substituts de la ration journalière totale pour contrôle du poids.
