Article R1333-39 of the French Public Health Code

I.-Distributors, suppliers and producers of natural materials or industrial residues likely to cause exposure to gamma radiation in excess of the reference level laid down in article R. 1333-38 must provide users of these natural materials or industrial residues with the mass concentrations of natural radionuclides present obtained by radiological characterisation.

II – The radiological characterisations provided for in I are carried out by bodies accredited by the French Accreditation Committee or by another member body of the European Cooperation for Accreditation that has signed multilateral mutual recognition agreements under the conditions laid down by an order of the Minister responsible for radiation protection.

Article R1333-39

I.-Les distributeurs, fournisseurs et producteurs de matériaux naturels ou de résidus industriels susceptibles de provoquer une exposition aux rayonnements gamma supérieure au niveau de référence fixé à l’article R. 1333-38 fournissent aux utilisateurs de ces matériaux naturels ou résidus industriels les concentrations massiques en radionucléides naturels présents obtenues par caractérisation radiologique.

II.-Les caractérisations radiologiques prévues au I sont réalisées par des organismes accrédités par le Comité français d’accréditation ou par un autre organisme membre de la Coopération européenne pour l’accréditation et ayant signé les accords de reconnaissance mutuelle multilatéraux dans les conditions prévues par un arrêté du ministre chargé de la radioprotection.
