Article R1334-10 of the French Public Health Code

The author of the lead exposure risk report drawn up in application of article L. 1334-5 identifies the elements containing a coating, specifies the lead concentration of these coatings and the analysis method used to measure it and describes the state of conservation of the coatings containing lead, in accordance with a protocol specified by a joint order of the ministers responsible for housing and health. Where appropriate, the inspector will include in the report a list of the factors mentioned in article L. 1334-5 that he has identified as contributing to the deterioration of the building.

When the author of the report sends a copy of the report to the Director General of the Regional Health Agency in application of article L. 1334-10, he informs the owner, the co-owners’ association or the operator of the accommodation.

L’auteur du constat de risque d’exposition au plomb établi en application de l’article L. 1334-5 identifie les éléments comportant un revêtement, précise la concentration en plomb de ces revêtements et la méthode d’analyse utilisée pour la mesurer et décrit l’état de conservation des revêtements contenant du plomb, selon un protocole précisé par un arrêté conjoint des ministres chargés du logement et de la santé. Il consigne, le cas échéant, dans le rapport du constat la liste des facteurs de dégradation du bâti mentionnés à l’article L. 1334-5 qu’il a relevés.

Lorsque l’auteur du constat transmet une copie du constat au directeur général de l’agence régionale de santé en application de l’article L. 1334-10, il en informe le propriétaire, le syndicat des copropriétaires ou l’exploitant du local d’hébergement.
