Article R1335-2 of the French Public Health Code

Any person who produces waste as defined in article R. 1335-1 is required to dispose of it. This obligation is incumbent on :

1° The health establishment, the teaching establishment, the research establishment or the industrial establishment, when this waste is produced in such an establishment;

2° The legal entity on behalf of which a healthcare professional carries out his waste-producing activity;

3° In other cases, to the natural person who carries out the waste-producing activity on a professional basis.

Article R1335-2

Toute personne qui produit des déchets définis à l’article R. 1335-1 est tenue de les éliminer. Cette obligation incombe :

1° A l’établissement de santé, l’établissement d’enseignement, l’établissement de recherche ou l’établissement industriel, lorsque ces déchets sont produits dans un tel établissement ;

2° A la personne morale pour le compte de laquelle un professionnel de santé exerce son activité productrice de déchets ;

3° Dans les autres cas, à la personne physique qui exerce à titre professionnel l’activité productrice de déchets.
