Article R1413-81 of the French Public Health Code

In each medico-social establishment or service or autonomous cosmetic surgery facility, the legal representative of the establishment organises the collection of reports relating to healthcare-associated infections and their transmission to the Director General of the Regional Health Agency.

In health establishments, the collection and transmission of reports of healthcare-associated infections, known as nosocomial infections under the terms of article R. 6111-6, are organised in accordance with the provisions of articles R. 6111-14 to R. 6111-17.

In health centres and nursing homes, an internal organisation for collecting and transmitting this information may also be defined.

A healthcare professional who, in the structure in which he or she practises or intervenes, informs the legal representative or the person designated by the legal representative without delay of the occurrence of a healthcare-associated infection in accordance with the organisation adopted, is deemed to have fulfilled the reporting obligation provided for in article L. 1413-14.

Dans chaque établissement ou service médico-social ou installation autonome de chirurgie esthétique, le représentant légal de l’établissement organise le recueil des déclarations relatives aux infections associées aux soins et leur transmission au directeur général de l’agence régionale de santé.

Dans les établissements de santé, le recueil et la transmission des déclarations d’infections associées aux soins, dénommées infections nosocomiales aux termes de l’article R. 6111-6, sont organisés conformément aux dispositions des articles R. 6111-14 à R. 6111-17.

Dans les centres de santé et les maisons de santé, une organisation interne de recueil et de transmission de ces informations peut également être définie.

Un professionnel de santé qui, dans la structure dans laquelle il exerce ou intervient, informe sans délai de la survenue d’une infection associée aux soins le représentant légal ou la personne désignée par celui-ci conformément à l’organisation adoptée est réputé avoir satisfait à l’obligation de déclaration prévue à l’article L. 1413-14.
