Article R1418-25 of the French Public Health Code

The information gathered in the course of the inspection shall be the subject of a report sent by the inspector in charge of the inspection to the Director General of the Agency. This report is sent to the person who was inspected. The person may make comments within fifteen days.

In the light of the shortcomings noted in the inspection report and these observations, the Director General may decide to suspend the authorisation or approval immediately until the person in question has brought itself into compliance with the legislative and regulatory provisions in force. Except in emergencies, the person concerned will be given the opportunity to present its observations before the suspension measure is taken.

If it is not up to the General Manager to suspend the licence, he will inform the competent authority of the shortcomings noted in the inspection report.

Les informations recueillies dans le cadre de la mission d’inspection font l’objet d’un rapport transmis par l’inspecteur chargé de la mission au directeur général de l’agence. Ce rapport est communiqué à la personne ayant fait l’objet de l’inspection. Elle peut faire valoir ses observations dans un délai de quinze jours.

Au vu des manquements constatés par le rapport d’inspection et de ces observations, le directeur général peut décider la suspension immédiate de l’autorisation ou de l’agrément jusqu’à ce que la personne en cause se soit mise en conformité avec les dispositions législatives et réglementaires en vigueur. Sauf cas d’urgence, elle est mise à même de présenter ses observations avant l’intervention de cette mesure de suspension.

Dans le cas où il n’appartient pas au directeur général de procéder à cette suspension, il informe l’autorité compétente des manquements constatés par le rapport d’inspection.
