Article R1432-56 of the French Public Health Code

The budget of the Regional Health Agency and the supplementary budget devoted to the management of appropriations from the Regional Intervention Fund and to the management of any appropriation paid to the Agency and intended to finance an action falling within the scope of the missions defined in the same article L. 1435-8 are prepared by the Director General, as authorising officer, and approved by the Supervisory Board of the Agency, unless otherwise voted by a two-thirds majority of the votes of the members present or represented.

Where one of these budgets has not been approved, the Managing Director of the Agency shall resubmit an amended draft budget to the Supervisory Board within fifteen days of the decision to reject it. On expiry of this period, or in the event of a further rejection, the budget is approved by a joint decision of the ministers responsible for health, the elderly, the disabled and the budget.

The decisions of the Supervisory Board approving the Agency’s budget and the supplementary budget or amendments thereto are enforceable at the end of a period of fifteen days from their receipt by the Ministers for Health, the Elderly and the Disabled, unless one of them objects within this period.

Le budget de l’agence régionale de santé et le budget annexe consacré à la gestion des crédits du fonds d’intervention régional ainsi qu’à la gestion de tout crédit versé à l’agence et destiné à financer une action entrant dans le champ des missions définies au même article L. 1435-8 sont préparés par le directeur général, en tant qu’ordonnateur, et approuvés par le conseil de surveillance de l’agence, sauf vote contraire à la majorité des deux tiers des voix des membres présents ou représentés.

Lorsque l’un de ces budgets n’a pas été approuvé, le directeur général de l’agence soumet à nouveau au conseil de surveillance un projet de budget modifié dans un délai de quinze jours suivant la délibération de rejet. A l’expiration de ce délai, ou en cas de nouveau rejet, le budget est arrêté par décision conjointe des ministres chargés de la santé, des personnes âgées, des personnes handicapées et du budget.

Les délibérations du conseil de surveillance approuvant le budget de l’agence et le budget annexe ou leurs modifications sont exécutoires à l’issue d’un délai de quinze jours à compter de leur réception par les ministres chargés de la santé, des personnes âgées et des personnes handicapées, sauf opposition de l’un d’entre eux dans ce délai.
