I.-In each department, the departmental prefect and the director general of the regional health agency draw up a protocol relating to the actions and services implemented by the agency on behalf of the departmental prefect.
II – The departmental protocol specifies the terms and conditions under which the Regional Health Agency is involved in preparing and, where necessary, implementing decisions falling within the remit of the departmental prefect in terms of health surveillance, health security and policing, as well as public health and hygiene. In particular, it specifies its actions with regard to:
1° Preparing or implementing decisions relating to hospitalisation without consent as provided for in articles L. 3211-11, L. 3211-11-1, L. 3212-8, L. 3213-1 to L. 3213-9, L. 3214-3 and L. 3214-4 ;
2° Protection against environmental health risks, including housing-related risks;
3° The health aspect of the emergency and defence plans provided for in the sixth paragraph of article L. 1435-1 ;
4° The provision of health advice required for the preparation of plans and programmes or any decision involving an assessment of their effects on human health;
5° The fight against diseases transmitted by insects in the departments mentioned in article L. 3114-5 and the fight against mosquitoes in the departments mentioned in 2° of article 1 of law no. 64-1246 of 16 December 1964 relating to the fight against mosquitoes;
6° Health checks at borders in departments affected by the implementation of international health regulations;
7° The inspections and controls provided for in the last paragraph of article L. 1435-7 ;
8° Requisition decisions taken in application of article L. 6314-1.
