Article R1453-11 of the French Public Health Code

I.-For the agreements referred to in 1° of Article R. 1453-10, each company shall make public the following information, in addition to its own identity including its corporate name, its corporate purpose and the address of its registered office:

1° The identity of each beneficiary of each agreement, i.e. :

a) In the case of a professional referred to in 1° of article L. 1453-2, the surname, first name, position, professional address and, where applicable, the professional association registration number or the personal identifier in the shared directory of healthcare professionals;

b) In the case of a student intending to become a veterinary surgeon or pharmacist, the surname, first name, name and address of the educational establishment and, where applicable, the registration number of the professional body or the personal identifier in the shared directory of health professionals;

c) In the case of a legal entity, the company name, the corporate purpose and the address of the registered office;

2° The date of signature of the agreement and its expiry date if known at the time of signature;

3° The purpose of the agreement, formulated with due respect for secrets protected by law, in particular business secrets;

4° Where the purpose of the agreement is a scientific and professional event or to promote the organiser, the name, date and location of the event.

II.-For the remuneration mentioned in 2° of article R. 1453-10, each company shall make public the following information, in addition to its own identity including its company name, its corporate purpose and the address of its registered office:

1° The identity of the beneficiary and of the company in accordance with the procedures set out in 1° of I of this article ;

2° The date and net amount, rounded to the nearest euro, of each remuneration paid to each beneficiary during a calendar half-year. The remunerations are made public on each payment due date in accordance with the payment procedures set out in the agreement;

3° The calendar half-year during which the remuneration was paid.

III -For the benefits mentioned in 3° of Article R. 1453-10, each company shall make public the following information, in addition to its own identity including its corporate name, its corporate purpose and the address of its registered office:

1° The identity of the beneficiary in accordance with the procedures set out in 1° of I of this article ;

2° The date, the amount including all taxes rounded to the nearest euro and the nature of each benefit received by the beneficiary during a calendar half-year.

I.-Pour les conventions mentionnées au 1° de l’article R. 1453-10, chaque entreprise rend publiques les informations suivantes, en plus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité de chaque bénéficiaire de chaque convention, soit :

a) Lorsqu’il s’agit d’un professionnel mentionné au 1° de l’article L. 1453-2, le nom, le prénom, la qualité, l’adresse professionnelle et, le cas échéant, son numéro d’inscription à l’ordre professionnel ou l’identifiant personnel dans le répertoire partagé des professionnels de santé ;

b) Lorsqu’il s’agit d’un étudiant se destinant à la profession de vétérinaire ou de pharmacien, le nom, le prénom, le nom et l’adresse de l’établissement d’enseignement et, le cas échéant, le numéro d’inscription à l’ordre ou l’identifiant personnel dans le répertoire partagé des professionnels de santé ;

c) Lorsqu’il s’agit d’une personne morale, la dénomination sociale, l’objet social et l’adresse du siège ;

2° La date de signature de la convention et sa date d’échéance si elle est connue au moment de la signature ;

3° L’objet de la convention, formulé dans le respect des secrets protégés par la loi, notamment du secret des affaires ;

4° Lorsque la convention a pour objet une manifestation à caractère scientifique et professionnel ou de promotion l’organisateur, le nom, la date et le lieu de la manifestation.

II.-Pour les rémunérations mentionnées au 2° de l’article R. 1453-10, chaque entreprise rend publiques les informations suivantes, en plus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité de la personne bénéficiaire et de l’entreprise selon les modalités prévues au 1° du I du présent article ;

2° La date et le montant net arrondi à l’euro le plus proche de chaque rémunération versée à chaque bénéficiaire au cours d’un semestre civil. Les rémunérations sont rendues publiques à chaque échéance de versement suivant les modalités de versement prévues par la convention ;

3° Le semestre civil au cours duquel les rémunérations ont été versées.

III.-Pour les avantages mentionnés au 3° de l’article R. 1453-10, chaque entreprise rend publiques les informations suivantes, en plus de sa propre identité comportant sa dénomination sociale, son objet social et l’adresse du siège social :

1° L’identité de la personne bénéficiaire selon les modalités prévues au 1° du I du présent article ;

2° La date, le montant toutes taxes comprises arrondi à l’euro le plus proche et la nature de chaque avantage perçu par le bénéficiaire au cours d’un semestre civil.
