Article R1453-18 of the French Public Health Code

The application for authorisation of an agreement is sent, by tele-procedure, by the person mentioned in article L. 1453-5, to the competent authority mentioned in article R. 1453-15.

The competent authority takes a decision within two months of receipt of the application. However, if, within one month of this date, it informs the applicant that the application is incomplete, it shall take a decision within two months of the date of receipt of the missing documents.

The competent authority sends its decision, with reasons in the event of refusal, by tele-procedure to the person who referred the matter to it, who is responsible for informing the natural or legal persons benefiting from the advantage. In the event of refusal, the person referred to in article L. 1453-5 may, within fifteen days of being notified of the refusal, submit an amended agreement to the competent authority. The competent authority will then take a new decision within a period of fifteen days, which it will send by tele-procedure to the person who referred the matter to it.

If there is no response within the first two-month period or within fifteen days of the proposed amendments following a refusal, the agreement is authorised.

If the person referred to in article L. 1453-5 transmits the agreement, indicating that it is urgent, the competent authority, if it deems the urgency justified, shall take a decision within three weeks and then, in the event of refusal followed by the transmission of an amended agreement, within one week. The agreement is authorised if, within the first period, the competent authority has not notified a refusal, indicated that the urgency is not justified or informed the applicant that the file is incomplete. The amended agreement is authorised if no refusal is notified within the second deadline.

Le dossier de demande d’autorisation d’une convention est transmis, par téléprocédure, par la personne mentionnée à l’article L. 1453-5, à l’autorité compétente mentionnée à l’article R. 1453-15.

L’autorité compétente statue dans un délai de deux mois à compter de la date de réception du dossier. Toutefois, si, dans le délai d’un mois à compter de cette date, elle informe le demandeur que le dossier est incomplet, elle statue dans un délai de deux mois à compter de la date de réception des pièces manquantes.

L’autorité compétente transmet sa décision, motivée en cas de refus, par téléprocédure à la personne qui l’a saisie, à charge pour elle d’en informer les personnes physiques ou morales bénéficiaires de l’avantage. En cas de refus, la personne mentionnée à l’article L. 1453-5 peut, dans un délai de quinze jours à compter de la notification du refus, lui soumettre une convention modifiée. L’autorité compétente prend alors une nouvelle décision dans un délai de quinze jours, qu’elle transmet par téléprocédure à la personne qui l’a saisie.

En l’absence de réponse dans le premier délai de deux mois ou dans le délai de quinze jours à compter des modifications proposées après un refus, la convention est autorisée.

Si la personne mentionnée à l’article L. 1453-5 transmet la convention en signalant l’urgence, l’autorité compétente, si elle estime l’urgence justifiée, se prononce dans un délai de trois semaines puis, en cas de refus suivi de la transmission d’une convention modifiée, dans un délai d’une semaine. La convention est autorisée si, dans le premier délai, l’autorité compétente n’a ni notifié un refus, ni indiqué que l’urgence n’est pas justifiée ou informé le demandeur que le dossier est incomplet. La convention modifiée est autorisée si un refus n’est pas notifié dans le second délai.
