Article R15-26 of the French Code of Criminal Procedure

The creation or abolition of the units referred to in the preceding articles is decided by decree when their territorial jurisdiction exceeds the limits of a department. It is decided by order of the Minister of the Interior when their territorial jurisdiction does not exceed these limits.

Their territorial jurisdiction is modified according to the same forms.

However, the creation of maritime gendarmerie, air gendarmerie and armament gendarmerie units is decided by order of the Minister of the Interior and the Minister of Defence. The creation of air transport gendarmerie units is decided by joint order of the Minister of the Interior and the Minister of Transport. The creation of motorway, air, river, nautical or mountain units of the departmental gendarmerie and specialised gendarmerie protection platoons placed near vitally important installations is decided by order of the Minister of the Interior.

La création ou la suppression des unités visées aux articles précédents est décidée par décret lorsque leur compétence territoriale excède les limites d’un département. Elle est décidée par arrêté du ministre de l’intérieur lorsque leur compétence territoriale n’excède pas ces limites.

Leur compétence territoriale est modifiée selon les mêmes formes.

Toutefois, la création des unités de la gendarmerie maritime, de la gendarmerie de l’air, de la gendarmerie de l’armement est décidée par arrêté du ministre de l’intérieur et du ministre de la défense. La création des unités de la gendarmerie des transports aériens est décidée par arrêté conjoint du ministre de l’intérieur et du ministre chargé des transports. La création des unités autoroutières, aériennes, fluviales, nautiques ou de montagne de la gendarmerie départementale et des pelotons spécialisés de protection de la gendarmerie placés auprès d’installations d’importance vitale est décidée par arrêté du ministre de l’intérieur.
