Where the obligation or obligations of the agreement are not fully performed, the interruption of performance of the agreement referred to in the seventeenth paragraph of Article 41-1-2 is recorded by the public prosecutor and notified to the representatives of the legal entity by registered letter with acknowledgement of receipt.
The victim is notified by any means.
If sums have been paid in respect of the public interest fine, the public prosecutor communicates the letter mentioned in the first paragraph to the accountant who received the payment for the purposes of restitution.
Where proceedings are instituted following the interruption of the performance of the agreement referred to in the seventeenth paragraph of Article 41-1-2, the file of the judicial public interest agreement proceedings shall be attached to the file of the proceedings before the court, so that account may be taken, in the event of a conviction, of the partial performance of the obligations imposed on the legal person.
