Article R15-33-9 of the French Code of Criminal Procedure

The Public Prosecutor at the Paris Court of Appeal shall order the withdrawal or suspension, for a period not exceeding two years, of the authorisation to carry out judicial police missions, by order issued either ex officio or on the proposal of the magistrate delegated to judicial missions of the customs and tax authorities.

The judge will first hear the customs officer, who may examine the file relating to the facts of which he or she is accused and be assisted by counsel of his or her choice.

A customs officer whose authorisation has been suspended automatically regains the right to perform judicial police duties at the request of the judicial authority when the suspension expires. The Public Prosecutor at the Paris Court of Appeal may, at any time, shorten the duration of the suspension.

After a withdrawal, the authorisation may only be reinstated in the manner provided for its initial attribution.

A posting outside the national judicial customs service entails the loss of the authorisation.

Le procureur général près la cour d’appel de Paris prononce le retrait ou la suspension, pour une durée n’excédant pas deux ans, de l’habilitation à effectuer des missions de police judiciaire, par arrêté pris soit d’office, soit sur proposition du magistrat délégué aux missions judiciaires de la douane et de l’administration fiscale.

Il entend préalablement l’agent des douanes, qui peut prendre connaissance du dossier relatif aux faits qui lui sont reprochés et se faire assister d’un conseil de son choix.

L’agent des douanes dont l’habilitation a été suspendue recouvre de plein droit, à l’expiration de la suspension, la faculté d’exercer des missions de police judiciaire sur réquisition de l’autorité judiciaire. Le procureur général près la cour d’appel de Paris peut, à tout moment, abréger la durée de la suspension.

Après un retrait, l’habilitation ne peut être rétablie que dans les formes prévues pour son attribution initiale.

L’affectation en dehors du service national de douane judiciaire entraîne la perte de l’habilitation.
