Article R1511-14 of the French General Code of Local Authorities

I. – Aid for property investment may only be granted if the beneficiary has submitted an application to this effect before the start of the investment.

Where the beneficiary is a large company, aid may only be granted if the application file shows that at least one of the following conditions is met:

a) A significant increase, as a result of the aid, in the size of the project or activity;

b) A significant increase, as a result of the aid, in the scope of the project or activity;

c) A significant increase, as a result of the aid, in the total amount spent by the beneficiary on the project or activity ;

d) A significant increase, as a result of the aid, in the speed with which the beneficiary carries out the project or activity;

e) Failing this, the fact that the project would not have been carried out in the regional aid area in which the investment is carried out without the aid applied for.

II. – The granting of aid for property investment is subject to the undertaking by the company to maintain its business for a period of at least five years on the land or in the buildings for which it has received aid. This period is three years for aid granted to small and medium-sized enterprises within the meaning of the regulation referred to in Article R. 1511-5. The agreement mentioned in Article L. 1511-3 sets out the conditions under which the local authority or grouping that granted the aid will recover it if the beneficiary company fails to honour its commitment.

III. – Aid for property investment may only be granted if at least 25% of the expenditure relating to the property investment is financed without any public aid. This rate is reduced to 20% in French Guyana.

I. – Les aides à l’investissement immobilier ne peuvent être accordées que si le bénéficiaire a présenté, avant le début de la réalisation de l’investissement, une demande à cet effet.

Lorsque le bénéficiaire est une grande entreprise, l’aide ne peut être accordée que si le dossier de demande montre qu’une au moins des conditions suivantes est remplie :

a) Un accroissement notable, résultant des aides, de la taille du projet ou de l’activité ;

b) Un accroissement notable, résultant des aides, de la portée du projet ou de l’activité ;

c) Une augmentation notable, résultant des aides, du montant total consacré par le bénéficiaire au projet ou à l’activité ;

d) Une augmentation notable, résultant des aides, de la rapidité avec laquelle le bénéficiaire réalise le projet ou l’activité ;

e) A défaut, le fait que le projet n’aurait pas été réalisé dans la zone d’aide à finalité régionale de réalisation de l’investissement sans l’aide demandée.

II. – L’octroi d’aides à l’investissement immobilier est subordonné à l’engagement de l’entreprise de maintenir pendant une période de cinq ans au moins son activité sur les terrains ou dans les bâtiments pour lesquels elle a bénéficié de l’aide. Ce délai est de trois ans pour les aides accordées aux petites et moyennes entreprises au sens du règlement mentionné à l’article R. 1511-5. La convention mentionnée à l’article L. 1511-3 prévoit les conditions dans lesquelles la collectivité territoriale ou le groupement qui a octroyé l’aide procède à sa récupération en cas de manquement de l’entreprise bénéficiaire à son engagement.

III. – Les aides à l’investissement immobilier ne peuvent être accordées que si 25 % au moins des dépenses liées à l’investissement immobilier sont financées sans aucune aide publique. Ce taux est ramené à 20 % en Guyane.
