Article R1511-3 of the French General Code of Local Authorities

The agreement provided for in the second paragraph of article L. 1511-7 sets out the obligations of each of the parties and specifies in particular:

a) The terms and conditions for awarding and paying the grant;

b) The amount and origin of all public aid defined in Article R. 1511-1 which the organisation plans to obtain for the year in respect of which the grant is requested;

c) The conditions under which the organisation will use grants from local and regional authorities and their groupings, and in particular the amount of aid, the form and the terms and conditions of their allocation;

d) The European Commission regulation and notified schemes concerning state aid for small and medium-sized enterprises that are applied;

e) The conditions for repayment of the grant in the event that the organisation does not comply with the agreement.

The repayment period may not exceed one year from the date on which non-compliance with the agreement is established.

The agreement must be appended to the decision to award the grant.

Article R1511-3

La convention prévue au deuxième alinéa de l’article L. 1511-7 fixe les obligations de chacune des parties et précise notamment :

a) Les modalités d’attribution et de versement de la subvention ;

b) Le montant et l’origine de l’ensemble des aides publiques définies à l’article R. 1511-1 dont l’obtention est prévue par l’organisme pour l’année au titre de laquelle la subvention est sollicitée ;

c) Les conditions d’utilisation par l’organisme des subventions des collectivités territoriales et de leurs groupements, et notamment le montant des aides, la forme et les modalités de leur attribution ;

d) Le règlement de la Commission européenne et les régimes notifiés concernant les aides d’Etat en faveur des petites et moyennes entreprises qui sont appliqués ;

e) Les conditions de reversement de la subvention dans le cas où l’organisme ne respecte pas la convention.

Le délai de reversement ne peut être supérieur à un an à compter de la constatation du non-respect de la convention.

La convention doit être annexée à la délibération décidant l’attribution de la subvention.
